Terms of Service
Effective September 28, 2026
These Terms govern your use of NGenSI. By creating an account, purchasing a plan, participating in a pilot, or using NGenSI, you agree to these Terms and our Privacy Policy.
Eligibility and accounts
You must be at least 18 and authorized to act for the business you represent. Provide accurate information, protect your login, and notify us promptly of suspected unauthorized access. You are responsible for activity performed through your account.
The service
NGenSI may provide business discovery, strategic intelligence, recommendations, generated content, campaign assets, scheduling guidance, campaign tracking, analytics displays, and optional third-party connections. Features may change as the service improves. Pilot and preview features may be incomplete, changed, suspended, or discontinued.
No guaranteed outcomes or professional advice
NGenSI does not guarantee revenue, leads, rankings, reach, engagement, cost savings, or any other business result. Outputs may contain errors or incomplete assumptions. NGenSI is not a substitute for legal, tax, accounting, employment, medical, financial, or other licensed professional advice.
Your content and permissions
You retain ownership of materials you submit. You grant us a limited license to host, process, reproduce, transform, and transmit those materials solely to operate and improve the requested services. You represent that you have the necessary rights and permissions. Subject to applicable law and provider terms, you may use generated outputs for your business after reviewing them.
Connected services and publishing
Third-party connections are optional and governed by the provider’s terms. You must have authority over every connected account. NGenSI may only publish or schedule content when the feature is available and you provide the required approval. You may revoke a connection at any time. Provider outages, policy changes, reviews, token expiration, or account restrictions may interrupt integrations.
Acceptable use
You may not use NGenSI to break the law or platform rules; facilitate fraud, spam, harassment, discrimination, malware, deceptive practices, or unauthorized political persuasion; impersonate others; infringe intellectual-property or privacy rights; obtain unauthorized access; scrape or reverse engineer protected systems; bypass security, quotas, approval gates, or rate limits; or resell access without written permission.
Subscriptions, limits, cancellation, and refunds
Paid plans renew at the price and interval disclosed at checkout until canceled. Usage limits reset on the stated schedule and do not roll over unless expressly stated. You may cancel through billing management; access generally continues through the paid period. Except where required by law, charges are non-refundable after a billing period begins. Report duplicate charges or billing errors within 14 days.
Suspension and termination
We may limit or suspend access to protect the service, comply with law, address nonpayment, investigate misuse, or prevent harm. You may stop using NGenSI at any time. Provisions that should reasonably survive termination—including ownership, payment obligations, disclaimers, and liability limitations—will survive.
Availability and changes
The service is provided on an “as available” basis. Maintenance, provider failures, security events, internet conditions, and circumstances outside our control may cause interruption. We may change features or these Terms; material changes will be posted with an updated effective date.
Disclaimers and limitation of liability
To the maximum extent permitted by law, NGenSI is provided “as is” without warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability. NGenSI will not be liable for indirect, incidental, special, punitive, or consequential damages, lost profits, lost data, or lost opportunities. Aggregate liability related to the service will not exceed the amount paid for NGenSI during the three months preceding the event giving rise to the claim.
Governing law
These Terms are governed by North Carolina law, without regard to conflict-of-law principles. Unless applicable law requires otherwise, disputes will be brought in the state or federal courts serving Wake County, North Carolina.
